Independent Surrogacy


Independent surrogacy is a journey that takes place without the use of an agency. There are many reasons for seeking an independent surrogate, and we want to help you make sure that you understand the things you may encounter.


Contracts

Just because you do not have a surrogacy agency does not mean that you will not have a written agreement. When you enter into a surrogacy contract with anyone, you need to make sure that you and the surrogate are both covered in case of problems and that your rights and obligations are clear from the beginning.

Attorneys

When signing any contract, you should hire an attorney to look over it for you. You do not want to be caught in an unfair contract and you probably do not want the journey to be unjust for the woman carrying your baby either. For this reason, you both will want independent legal representation.

Fees

Although you will be pursuing an independent journey, the surrogate will have fees that are standard to be paid, but she may also have some additional expenses that she requests to be paid. Before signing the contract or agreeing to fees, be sure that you understand the fees and why they are requested. You may also negotiate for the percentages and fees that you will allow.

Medications and Medical Services

If you have vitamins or medications that you do or do not want your surrogate taking, you need to discuss this from the beginning. You do not want to be fighting with your surrogate later over a medication.

Abortion or Selective Reduction

If you are experiencing difficulties getting pregnant, you may not even be considering abortion, but there are some cases that may warrant abortion. The surrogate and intended parents need to be on the same page with this.


Payments

How will you have the surrogate submit for payments? This may seem like a boring thing to handle, but without an agency you must negotiate this with the surrogate. Put it in writing so that everyone agrees.

Mediation

We hope that you do not have a problem, but they do sometimes arise. You should make sure that you and your surrogate know what needs to be done if you need a mediator or third party to help.

Birth

Who will be present at the birth and how will you be given your new baby? You also want to know if the birth will be medicated or natural, at home or in a birthing facility or hospital, water birth or other birthing style. This may seem like it is up to the surrogate, but you should understand and agree to the process as well.
